Welcome to BondXe! These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and BondXe ("Company", "we", "us", or "our") governing your access to and use of the BondXe mobile application, website, and all related services, features, content, and functionality (collectively, the "Service" or "Services"). By accessing, downloading, installing, or using the Service in any manner, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
IMPORTANT NOTICE: These Terms contain important legal provisions, including mandatory arbitration, class action waivers, limitations of liability, disclaimers of warranties, and indemnification obligations. Please read these Terms carefully before using the Service. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service and delete the application from your device.
By creating an account, accessing, downloading, installing, or using the Service, you represent and warrant that: (a) you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater; (b) you have the legal capacity and authority to enter into this Agreement; (c) you will comply with all applicable local, state, national, and international laws and regulations; (d) all information you provide is accurate, current, and complete; and (e) you are not prohibited from using the Service under applicable law or by any prior agreement with us.
We reserve the absolute right, in our sole and exclusive discretion, to modify, update, change, or replace these Terms at any time, for any reason, with or without notice. Material changes will be communicated through the Service, email, or other reasonable means, but your continued use of the Service after such modifications constitutes your acceptance of the modified Terms. If you do not agree to any modifications, you must immediately stop using the Service and terminate your account. You are solely responsible for regularly reviewing these Terms to stay informed of any changes.
BondXe is a social networking and interest-based connection platform that facilitates connections between users based on shared interests, preferences, and compatibility algorithms. The Service includes, but is not limited to:
NO GUARANTEES: We do not guarantee, warrant, or represent that: (a) you will receive any matches, connections, or group invitations; (b) any matches or connections will be successful, compatible, or lead to any relationships; (c) the Service will meet your specific requirements or expectations; (d) the Service will be uninterrupted, timely, secure, error-free, or free from viruses or harmful components; (e) any information, content, or data provided through the Service is accurate, reliable, or complete; or (f) defects or errors will be corrected. The Service is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied.
To access certain features of the Service, you must create an account by providing accurate, current, and complete information, including but not limited to: mobile number, email address, username, profile information, interests, preferences, and any other information requested during registration. You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password, mobile number, email, and any authentication codes. You agree to immediately notify us of any unauthorized access, use, or breach of security of your account.
You are entirely responsible for all activities, actions, communications, content, and transactions that occur under your account, whether authorized by you or not. We are not liable for any loss or damage arising from your failure to comply with this security obligation. You may not share, transfer, sell, or assign your account to any third party. We reserve the right to suspend, terminate, or refuse service to any account, at any time, for any reason or no reason, with or without notice, in our sole and absolute discretion.
You agree that you will maintain only one account at any given time. Creating multiple accounts, using false information, impersonating others, or using accounts belonging to others is strictly prohibited and may result in immediate termination of all your accounts and legal action.
ZERO-TOLERANCE FOR OBJECTIONABLE CONTENT: BondXe has a strict zero-tolerance policy for objectionable content and abusive behavior. We are committed to maintaining a safe, respectful, and inclusive community. Any user who violates these guidelines will face immediate action, including permanent account termination without refund.
Prohibited Content and Behavior: The following are strictly prohibited and will result in immediate removal and account termination:
Reporting and Enforcement: Users can report objectionable content or abusive users through the in-app reporting mechanism. Our moderation team reviews all reports within 24 hours and takes appropriate action, which may include content removal and permanent account termination. Blocking a user will immediately remove their content from your feed and notify our team for review.
Child Safety Standards: BondXe has a strict zero-tolerance policy for child sexual abuse and exploitation (CSAE). For detailed information about our child safety policies, reporting mechanisms, and compliance with child safety laws, please refer to our Child Safety Standards document, which is incorporated into these Terms by reference.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to, and you will not permit, encourage, or assist any third party to:
We reserve the absolute right, but not the obligation, to monitor, review, screen, edit, modify, refuse, remove, or delete any content, communications, or user activity at any time, for any reason or no reason, without notice, in our sole and absolute discretion. We are not responsible for any user-generated content and do not endorse, verify, or guarantee the accuracy, completeness, or quality of any such content.
You retain ownership of any content you create, upload, post, transmit, or share through the Service ("User Content"). However, by submitting User Content to the Service, you hereby grant to BondXe and its affiliates, successors, and assigns a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable license to use, reproduce, distribute, publicly display, publicly perform, modify, adapt, translate, create derivative works from, and otherwise exploit your User Content in any manner, for any purpose, in any media or format now known or hereafter developed, without any compensation, attribution, or notice to you.
You represent and warrant that: (a) you own or have all necessary rights, licenses, consents, and permissions to grant the license set forth above; (b) your User Content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or other rights; (c) your User Content does not and will not violate any applicable law or regulation; and (d) your User Content is not defamatory, libelous, obscene, pornographic, or otherwise illegal. You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your User Content or any breach of these representations and warranties.
The Service offers various subscription plans (Free, Silver, Diamond) and in-app purchases (including but not limited to boost credits, premium features, and additional capabilities). Subscription fees, pricing, features, and terms are subject to change at any time, with or without notice, in our sole discretion. All fees are quoted in your local currency (e.g., Indian Rupees) and are exclusive of applicable taxes, which you are solely responsible for paying.
By purchasing a subscription or making an in-app purchase, you agree to pay all fees and charges associated with your purchase. Payments are processed through third-party payment processors (e.g., Apple App Store, Google Play Store, RevenueCat). You agree to provide current, accurate, and complete payment information. You authorize us or our payment processors to charge your chosen payment method for all fees and charges. All sales are final, and we do not provide refunds except as required by applicable law or as expressly stated in these Terms.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your device's subscription settings or by contacting us. Cancellation will take effect at the end of the current billing period, and you will continue to have access until that time. We reserve the right to change subscription prices at any time, with notice to you. Price changes will apply to subsequent billing periods.
We may offer free trials or promotional subscriptions. Free trials automatically convert to paid subscriptions unless cancelled before the trial period ends. We reserve the right to modify, suspend, or terminate any free trial or promotional offer at any time, for any reason, with or without notice.
No Refunds: Except as required by applicable law, all fees are non-refundable. If you are dissatisfied with the Service for any reason, your sole remedy is to discontinue use and cancel your subscription. We are not obligated to provide refunds, credits, or compensation for any reason, including but not limited to: dissatisfaction with matches, lack of connections, service interruptions, changes to features, or termination of your account.
YOUR SOLE RESPONSIBILITY: You are solely and entirely responsible for your interactions, communications, meetings, and relationships with other users of the Service. We are not a party to, and we do not facilitate, arrange, or guarantee any meetings, relationships, or interactions between users. We do not conduct background checks, verify identities, or screen users beyond our profile verification process, which is not a guarantee of safety, authenticity, or good character.
NO LIABILITY FOR USER INTERACTIONS: We expressly disclaim all liability for any harm, loss, damage, injury, death, or other consequences arising from or related to: (a) your interactions with other users, whether online or in person; (b) meetings, dates, or gatherings arranged through the Service; (c) the conduct, actions, statements, or representations of other users; (d) any content, information, or communications shared by other users; (e) any decisions you make based on information provided through the Service; or (f) any other consequences of using the Service to connect with others.
When interacting with other users, especially in person, you agree to: (a) meet only in public, well-lit, and safe locations; (b) inform a trusted friend or family member of your plans, location, and expected return time; (c) use your own transportation and maintain control of your personal belongings; (d) trust your instincts and leave immediately if you feel uncomfortable or unsafe; (e) never share personal financial information, passwords, or sensitive data; (f) report any suspicious, harmful, or illegal behavior immediately through the Service's reporting mechanisms; and (g) comply with all applicable health and safety guidelines, including but not limited to COVID-19 protocols.
The Service may include safety features such as SOS functionality, emergency contacts, and reporting mechanisms. These features are provided "as is" without any warranties. We do not guarantee that these features will function properly, be available at all times, or prevent any harm. In case of emergency, you should immediately contact local emergency services (e.g., 911, 112, or your local emergency number). We are not responsible for the availability, accuracy, or effectiveness of any emergency services or safety features.
Your privacy is important to us. Our collection, use, storage, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy and agree that we may collect, use, store, process, and disclose your information as described therein.
You acknowledge and agree that: (a) we may collect and use your location data, device information, usage data, and other information as described in our Privacy Policy; (b) we may share your information with other users as part of the Service (e.g., profile information, group memberships); (c) we may use your information for analytics, advertising, marketing, and other business purposes; (d) we may transfer your information to servers located in different countries; and (e) we are not responsible for the privacy practices of other users or third parties.
The Service, including but not limited to its design, text, graphics, logos, icons, images, audio, video, software, code, algorithms, user interfaces, and all other content and materials, is owned by BondXe, its licensors, or other providers and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You acknowledge that the Service contains proprietary and confidential information.
You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial use in accordance with these Terms. This license does not include any right to: (a) reproduce, distribute, publicly display, publicly perform, or create derivative works of the Service; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code; (c) remove, alter, or obscure any proprietary notices; (d) use any automated means to access the Service; or (e) use the Service for any commercial purpose without our prior written consent.
All trademarks, service marks, logos, and trade names displayed on the Service are the property of BondXe or their respective owners. You may not use, copy, modify, or display any such marks without our prior written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, AND ACCURACY.
We do not warrant, guarantee, or represent that: (a) the Service will be uninterrupted, timely, secure, error-free, or free from viruses, malware, or harmful components; (b) defects or errors will be corrected; (c) the Service will meet your requirements or expectations; (d) any information, content, or data provided through the Service is accurate, reliable, complete, or current; (e) the Service will be compatible with your device or software; (f) the Service will be available at all times or in all locations; (g) any matches, connections, or recommendations will be successful or lead to desired outcomes; (h) user profiles are authentic, accurate, or truthful; (i) the Service will prevent any harm, loss, or damage; or (j) the Service will comply with all applicable laws in your jurisdiction.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. However, to the fullest extent permitted by law, we disclaim all warranties to the maximum extent allowed by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BONDXE, ITS AFFILIATES, SUBSIDIARIES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, OR SHAREHOLDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) YOUR INTERACTIONS WITH OTHER USERS; (C) MEETINGS, DATES, OR GATHERINGS ARRANGED THROUGH THE SERVICE; (D) ANY CONDUCT, ACTIONS, STATEMENTS, OR REPRESENTATIONS OF OTHER USERS; (E) ANY CONTENT, INFORMATION, OR COMMUNICATIONS SHARED THROUGH THE SERVICE; (F) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (G) ERRORS, MISTAKES, OR INACCURACIES IN THE SERVICE; (H) INTERRUPTIONS, DELAYS, OR CESSATION OF THE SERVICE; (I) VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS; (J) LOSS OR DAMAGE TO YOUR DEVICE OR DATA; (K) PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE; OR (L) ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you. However, to the fullest extent permitted by law, our liability is limited to the maximum extent allowed by applicable law.
The limitations and exclusions set forth in this section apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless BondXe, its affiliates, subsidiaries, licensors, service providers, employees, agents, officers, directors, shareholders, and representatives from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees, court costs, and settlement costs) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms or any applicable law or regulation; (c) your violation of any rights of any third party, including but not limited to intellectual property rights, privacy rights, or publicity rights; (d) your User Content; (e) your interactions with other users, including but not limited to meetings, dates, or gatherings; (f) your conduct, actions, statements, or representations; (g) any harm, loss, damage, injury, or death caused by you or arising from your use of the Service; or (h) any other matter for which you are responsible or that arises from your use of the Service.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with us in defending such claims. You agree not to settle any matter without our prior written consent.
We reserve the right, in our sole and absolute discretion, to suspend, restrict, limit, or terminate your access to and use of the Service, or any portion thereof, at any time, for any reason or no reason, with or without notice, including but not limited to: (a) violation of these Terms; (b) violation of any applicable law or regulation; (c) fraudulent, abusive, or illegal activity; (d) requests by law enforcement or government agencies; (e) discontinuance or material modification of the Service; (f) technical or security issues; (g) extended periods of inactivity; or (h) any other reason we deem necessary or appropriate.
You may terminate your account at any time by deleting the application from your device and contacting us through the Service's support section. Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete or deactivate your account and all associated data, content, and information; (c) you will not be entitled to any refunds, credits, or compensation; and (d) all provisions of these Terms that by their nature should survive termination will survive, including but not limited to Sections 6 (User Content License), 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 16 (Dispute Resolution), and 17 (General Provisions).
The Service may contain links to third-party websites, services, applications, or resources that are not owned or controlled by BondXe. We are not responsible for the content, privacy practices, terms of service, or practices of any third-party services. Your interactions with third-party services are solely between you and the third party. We encourage you to read the terms of service and privacy policies of any third-party services you access.
We may use third-party services to provide certain features of the Service, including but not limited to payment processing, analytics, advertising, cloud storage, and push notifications. Your use of such third-party services may be subject to additional terms and conditions. We are not liable for any acts, omissions, or conduct of any third-party service providers.
MANDATORY ARBITRATION: Except as otherwise set forth in this section, any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or your use of the Service ("Dispute") shall be resolved exclusively through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration shall be conducted in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996, as modified by these Terms. The arbitration shall be conducted in Mumbai, India in the English language. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
CLASS ACTION WAIVER: YOU AND BONDXE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU FURTHER AGREE THAT NO ARBITRATION OR PROCEEDING SHALL BE JOINED WITH ANY OTHER ARBITRATION OR PROCEEDING INVOLVING ANOTHER PARTY, WHETHER THROUGH CLASS ARBITRATION PROCEEDINGS OR OTHERWISE.
Exceptions: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm, and either party may bring an action in small claims court if the claim qualifies.
Waiver of Jury Trial: YOU AND BONDXE HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms that is not subject to arbitration shall be brought exclusively in the courts of Mumbai, India, and you consent to the personal jurisdiction of such courts.
These Terms, together with our Privacy Policy and any other legal notices or agreements referenced herein, constitute the entire agreement between you and BondXe regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, relating to the subject matter hereof.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall remain in full force and effect.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign, transfer, or delegate these Terms or your rights or obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms or our rights or obligations hereunder without restriction.
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, network or equipment failures, or other causes beyond our reasonable control.
We may provide notices to you through the Service, by email, or by other reasonable means. You agree that such notices constitute sufficient notice. You may provide notices to us through the Service's support section or by email to bondxe.pvt.ltd@gmail.com.
The Service is intended for users who are at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. If you are under 18, you may not use the Service. If we become aware that we have collected personal information from a user under 18, we will take steps to delete such information and terminate the account.
You agree to comply with all applicable export control laws and regulations. You may not use, export, re-export, or transfer the Service in violation of any applicable law or regulation.
